The terms that apply to this website and to our payroll and pension administration services.
01About these terms
These terms apply to your use of this website and, together with your engagement letter or proposal, to the payroll and pension administration services provided by My Payroll Solutions LTD trading as MyPayrollSolutions.
If there is a conflict between these terms and a signed engagement letter, the engagement letter prevails. By using this website or instructing us, you agree to these terms.
02Our services
We provide the services described in your engagement letter, which may include payroll processing, RTI submissions to HMRC, statutory pay calculations, auto-enrolment administration, pension contribution submissions, payslips and reporting.
We will perform the services with reasonable skill and care and in line with the law as it applies to payroll and pension administration in the United Kingdom.
03No financial, tax or legal advice
We administer payroll and pension duties. We do not provide regulated financial or investment advice, and nothing on this website or in our services is financial, tax, legal or pension scheme advice. You should take independent advice from a suitably qualified and authorised adviser, such as one authorised by the Financial Conduct Authority, where you need it.
04Your responsibilities
To allow us to deliver the services on time you agree to:
- give us complete and accurate information, including starter, leaver, hours, pay and absence details, by the cut-off dates we agree;
- tell us promptly about changes that affect payroll or pensions;
- approve each pay run before it is paid and make sure funds are available to pay wages, tax, National Insurance and pension contributions when due;
- remain responsible for your legal duties as an employer, including those under employment, tax and pension law;
- check payslips, reports and submissions and tell us about any errors as soon as you find them.
We are not responsible for delays, errors, interest or penalties caused by information that is late, incomplete or inaccurate, or by funds not being available on time.
05Fees and payment
Our fees are set out in your quote or engagement letter. Unless it says otherwise, invoices are payable within 14 days of the invoice date, and fees exclude VAT, which we add where it applies.
If an invoice is overdue we may charge interest and compensation under the Late Payment of Commercial Debts (Interest) Act 1998 and, after giving notice, suspend the services until payment is made. We may revise our fees on reasonable written notice.
06Data protection
Each of us will comply with the UK GDPR and the Data Protection Act 2018. For employee and worker data, you are the controller and we are your processor. We will process that data only on your documented instructions, keep it confidential and secure, use sub-processors under written contracts, help you meet your data subject rights obligations, and delete or return the data when the services end.
These terms, together with your engagement letter, are intended to meet the processor contract requirements of Article 28 UK GDPR. Our Privacy Policy explains how we handle personal data in more detail.
07Confidentiality
Each party will keep the other’s confidential information private and use it only to carry out the services, unless disclosure is required by law, a regulator or a court, or is needed to deliver the services (for example, filing with HMRC).
08Our liability
Nothing in these terms limits or excludes liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything that cannot lawfully be limited.
Subject to that, we are not liable for indirect or consequential loss, or for loss of profit, revenue or goodwill. Our total liability to you for all claims arising from the services in any 12-month period is limited to the fees you paid us for those services in that period, unless your engagement letter states a different limit.
Where an error is ours, we will correct it promptly at no extra charge. Where we have caused you to incur an HMRC or pension penalty through our own error, we will help you to challenge it and will reimburse it up to the limit above.
09Starting and ending the services
The services begin on the start date in your engagement letter. Either of us may end the services by giving the written notice stated in the engagement letter. Either party may end the agreement immediately if the other commits a serious breach that is not fixed within 14 days of notice, or becomes insolvent.
When the services end we will hand over the records you need, such as year-to-date figures, in a reasonable timeframe. Our fees up to the end date remain payable.
10Using this website
This website is provided for general information. We try to keep it accurate and up to date, but we do not guarantee that it is complete, and tax and pension rules and thresholds change. Do not rely on it as advice.
All content, branding and design on this site belongs to us or our licensors. You may view and share pages for personal or internal business use but must not copy or reuse content commercially without our written permission. Do not misuse the website, attempt to gain unauthorised access, or introduce malicious code.
11Events beyond our control
Neither party is liable for delay or failure caused by events beyond its reasonable control, such as power or internet failure, HMRC or banking system outages, or severe weather. We will tell you promptly and take reasonable steps to limit the impact.
12General
If any part of these terms is found unenforceable, the rest remains in force. A failure to enforce a right is not a waiver of it. You may not transfer your rights under these terms without our written consent. Only the parties to an agreement may enforce it.
We may update these terms from time to time. The version on this page applies to your use of the website, and changes to the services terms apply from the date we notify you in writing. Last updated: 16 October 2026.
13Governing law and contact
These terms and any dispute arising from them are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer in Scotland or Northern Ireland you may also bring proceedings in your local courts.
